1. Agreement and Eligibility
These Terms of Service (the "Terms") form a binding agreement between you and Autohire Enterprises LLC, doing business as AutoHire ("AutoHire," "we," "us," or "our"). They govern your use of www.autohire.com, AutoHire mobile applications, Spark messaging, and related services (collectively, the "Platform").
You must be at least 18 years old and legally able to enter a contract. By creating an account, clicking acceptance, or using the Platform, you agree to these Terms and acknowledge the Privacy Policy, AI Disclosure, and Cookie Policy. If you use AutoHire for an Employer, you represent that you are authorized to bind that Employer.
2. AutoHire's Role
AutoHire is a technology marketplace for automotive careers. We support discovery, recommendations, applications, communications, and workflow. AutoHire is not an employer, staffing agency, employment agency, background-check provider, or agent of any Candidate or Employer unless we expressly agree otherwise in writing.
Employers—not AutoHire—control requisitions, interviews, offers, hiring decisions, employment terms, and compliance with employment laws. AutoHire does not guarantee that a Candidate will receive an interview or offer, that an Employer will fill a role, or that content supplied by another user is accurate.
3. Accounts and Employer Roles
Each person must maintain an individual account and accurate Candidate Profile before acting for an Employer.
Super Admins control billing, administrators, settings, permissions, and the Employer account.
Admins may build Company Profiles, create and manage Requisitions, manage messages, and assign Hiring Managers.
Hiring Managers receive access only to assigned Requisitions, may communicate through Spark, and may add internal Candidate comments.
Employer users are responsible for protecting credentials and for activity taken under their accounts. Shared administrative credentials are prohibited.
AutoHire manually reviews an Employer after its Company Profile is created and before publication. An Admin or Super Admin must verify through an email address associated with the Employer's corporate domain. Verification reduces risk but is not an endorsement or guarantee.
4. Candidate Profiles, Visibility, and Blocking
Candidates control the information they provide and must keep it accurate. A Candidate may upload a resume and may choose to add an optional photograph. Photographs are not used for matching, ranking, resume parsing, or AI analysis and must not be used to infer protected or sensitive traits.
Candidates may block one or more business profiles that exist in AutoHire when the block is selected. A selected business-level block applies to that organization and its associated Super Admins, Admins, and Hiring Managers, and removes the Candidate from that business's search, recommendations, and direct-profile access. A block does not automatically apply to a business profile created after the block is selected. Candidates are responsible for periodically searching AutoHire and adding newly available business profiles they wish to block. AutoHire cannot guarantee that every business, affiliate, or later-created profile will be identified or blocked, and will not tell a business that it was specifically blocked.
Blocking does not automatically erase information already shared through an application or Spark conversation. An Employer may retain previously received information as permitted by law and its own policies. AutoHire may retain limited records for security, disputes, fraud prevention, and legal obligations.
5. Requisitions, Applications, and Employer Responsibilities
Employers must describe genuine Career Opportunities accurately and identify material qualifications, location, compensation information where required, and employment conditions.
Employers may use Candidate information only for legitimate recruiting, hiring, workforce planning, and related compliance purposes.
Employers must not discriminate, request unlawful information, misrepresent opportunities, scrape profiles, resell Candidate data, or use the Platform for unrelated solicitation.
Candidates are responsible for deciding what to submit, verifying Employer and opportunity information, and exercising judgment before interviews, travel, or sharing additional data.
AutoHire does not perform background checks. Any future reference integration will be separately disclosed and governed.
6. Spark Messaging and Communications
Spark is AutoHire's messaging platform for Candidate-Employer communications. Users must communicate lawfully and professionally and may not send harassment, threats, discriminatory content, spam, malware, deceptive offers, payment requests, or content unrelated to legitimate Platform activity.
We may use automated tools and human review to detect abuse, protect users, investigate reports, and enforce these Terms, subject to the Privacy Policy. Users may block or report communications. We do not promise that messages will be delivered, read, retained forever, or free from error.
7. Notifications, Email, and SMS
Service communications may include MFA codes, security notices, application activity, Requisition status, billing, policy changes, and support messages. At launch, SMS may be used for MFA, new Candidate applications, and Requisition-live notices. Later features may include Spark alerts, job-interest notices, and interview-scheduling alerts.
Consent to marketing texts is not a condition of purchasing or using AutoHire. Message and data rates may apply; frequency varies. You may reply STOP to promotional texts and HELP for help. Transactional or security messages may continue where permitted and necessary. You are responsible for providing a number you control and updating it if it changes.
8. AI-Assisted Features
AutoHire may use artificial intelligence or automated tools to parse resumes, structure job descriptions, suggest or rank Career Opportunities, recommend Candidates, draft content, explain recommendations, and identify trends. AI output may be incomplete, inaccurate, or inappropriate and must be reviewed before use.
AutoHire's AI supports—but does not replace—human judgment. It does not make final employment decisions. Employers may not treat an AutoHire recommendation, summary, or score as the sole or determinative basis for an employment decision. See the AI Disclosure for additional safeguards and correction options.
9. User Content and License
You retain ownership of content you submit. You grant AutoHire a worldwide, non-exclusive, royalty-free license to host, copy, format, display, transmit, analyze, and otherwise process that content only as reasonably necessary to operate, secure, improve, and provide the Platform; honor your settings; comply with law; and create de-identified or aggregate insights.
You represent that you have the rights and permissions needed to provide your content. You may not upload confidential information belonging to another person, infringing materials, trade secrets without authorization, unlawful content, or malicious code.
10. Acceptable Use
Do not scrape, harvest, crawl, copy, reverse engineer, probe, overload, disrupt, or bypass security or access controls except with written authorization.
Do not impersonate others, create fraudulent accounts, manipulate rankings, submit fake applications or Requisitions, or misstate affiliation or credentials.
Do not use Platform data to build competing databases, train unrelated models, advertise unrelated products, or make unlawful eligibility decisions.
Do not upload special-category or sensitive information unless the Platform expressly requests it for a lawful purpose.
Do not use photographs or profile information to infer race, ethnicity, religion, disability, health, age, sexual orientation, or other protected or sensitive traits.
11. Employer Plans, Billing, and Taxes
Launch pricing is subject to change with appropriate disclosure and, for renewals, advance notice where required: annual access is $1,603.80 (a 10% discount from twelve monthly payments totaling $1,782); monthly access is $148.50 per month; and per-Requisition access is $35 per Requisition. Candidates pay no launch fee.
Stripe processes payments. By submitting payment information, an Employer authorizes AutoHire and Stripe to charge applicable fees, recurring amounts, taxes, and agreed adjustments. Employers must keep payment and billing information current. AutoHire may suspend paid features for failed or disputed payments.
Monthly and annual plans renew automatically until canceled, unless checkout states otherwise. AutoHire will provide renewal disclosures required by law. Cancellation stops future renewal but does not ordinarily reverse a charge already incurred.
12. Refunds
Annual plan: cancel renewal at any time. A refund requested within 14 days of the initial purchase is available only if the Employer has not published a Requisition, viewed restricted Candidate information, or sent a Spark message.
Monthly plan: cancel at any time, effective at the end of the paid period; no prorated refund except where law requires.
Per Requisition: refundable until publication. After publication, refunds are limited to duplicate billing, Platform error, AutoHire rejection, or material service failure attributable to AutoHire.
Approved refunds return to the original payment method when practicable. Processing times depend on Stripe and the financial institution.
13. Intellectual Property
AutoHire and its licensors own the Platform, software, design, Automotive Taxonomy, branding, documentation, and other materials excluding User Content. Subject to these Terms, AutoHire grants you a limited, revocable, non-transferable license to use the Platform for its intended purpose. No rights are granted by implication.
14. Third-Party Services
The Platform may use or link to third-party services, including payment, AI-processing, app-distribution, analytics, advertising, communications, and infrastructure providers. Their terms and privacy practices may apply to their services. AutoHire is not responsible for independent third-party services, but remains responsible for its own representations and legal obligations.
15. Moderation, Suspension, and Appeals
AutoHire may investigate, restrict, remove, decline to publish, suspend, or terminate accounts or content to protect users, comply with law, address nonpayment, or enforce these Terms. When practicable, we will explain material moderation or account actions.
A user may request correction or human review through service@autohire.com. AutoHire aims to acknowledge ordinary requests within two business days and resolve them within ten business days, although complex, urgent, or legally restricted matters may take longer. Employment decisions made by an Employer must be addressed with that Employer.
16. Account Closure and Data Retention
You may close your account through available account controls or by contacting support. Closure ends access but does not necessarily delete every record immediately. The Privacy Policy describes deletion, retention, backup expiration, legal holds, and information previously shared with other users.
17. Changes to the Platform or Terms
AutoHire may change features and these Terms. We will provide notice of material changes and obtain consent where law requires. Changes do not retroactively authorize materially different uses of personal data without appropriate notice or consent. Continued use after an effective date constitutes acceptance where permitted.
18. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." AUTOHIRE DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RESULTS. AUTOHIRE DOES NOT GUARANTEE EMPLOYMENT OUTCOMES, USER IDENTITY, CONTENT ACCURACY, MESSAGE DELIVERY, OR UNINTERRUPTED SERVICE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO THEY MAY NOT APPLY TO YOU.
19. Limitation of Liability and Indemnity
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTOHIRE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST OPPORTUNITIES, OR LOSS OF DATA. AUTOHIRE'S AGGREGATE LIABILITY ARISING FROM THE PLATFORM WILL NOT EXCEED THE GREATER OF $100 OR THE FEES YOU PAID AUTOHIRE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITS DO NOT APPLY WHERE PROHIBITED OR TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED.
An Employer will defend and indemnify AutoHire against third-party claims arising from its Requisitions, employment practices, misuse of Candidate data, violation of law, or breach of these Terms. Other users will indemnify AutoHire for third-party claims arising from their unlawful content or intentional misuse, to the extent permitted by law.
20. Dispute Resolution; Arbitration; Class Waiver
Please read this section carefully. Except for small-claims matters, requests for urgent injunctive relief, and disputes that cannot lawfully be arbitrated, you and AutoHire agree to resolve covered disputes through binding individual arbitration after completing the informal process below.
Informal process. Before filing arbitration, the claimant must send a written notice describing the dispute and requested relief to service@autohire.com and allow 30 days for a good-faith resolution conference. Limitations periods are tolled during this period where permitted.
Arbitration. Arbitration will be administered by the American Arbitration Association under its applicable consumer or commercial rules. If AAA is unavailable or cannot fairly administer the matter, the parties will select JAMS or another mutually acceptable administrator. The Federal Arbitration Act governs arbitrability; Arizona law governs other matters without overriding nonwaivable rights of another state.
Individual proceedings only. Claims must be brought individually, not as a class, collective, consolidated, mass, or representative action, except to the extent this waiver is unenforceable. If a court finally determines that a particular request for public injunctive relief cannot be waived, that request may proceed in court after individual arbitrable claims are resolved.
Opt out. A Candidate or Small Employer may opt out by emailing service@autohire.com within 30 days after first accepting these Terms. The notice must identify the account, state the decision to opt out, and be sent by the Candidate or an authorized representative. “Small Employer” means an Employer with fewer than 100 employees.
Non-arbitrable matters. Courts located in Maricopa County, Arizona have exclusive jurisdiction over non-arbitrable disputes, subject to any nonwaivable right to bring a claim elsewhere. Nothing limits either party's right to report concerns to a government agency or an agency's authority to investigate or obtain relief.
21. General Terms
These Terms and incorporated policies are the entire agreement about the Platform unless a signed agreement states otherwise. If a provision is unenforceable, it will be narrowed or severed while the remainder continues. Failure to enforce is not a waiver. You may not assign these Terms without consent; AutoHire may assign them in connection with a merger, financing, reorganization, or sale of assets, subject to applicable law and privacy commitments.
